Terms of Sale

These terms apply to every order placed on merchsetgo.com, a store operated by Friedmans Premier System, Inc. (doing business as iPromo LLC) ("we," "us"). By placing an order you agree to them. Any different terms in your purchase order do not apply unless an officer of iPromo agrees in writing.

Orders

An order is final once we accept it. We may refuse or limit any order. You approve each product's logo, placement, size, color and quantity in your cart before checkout. An artist checks every order before print, and if something needs a fix we email a proof and wait for your OK. You are responsible for errors in a design you approved.

Your logo

You confirm that the logos and artwork you upload do not infringe anyone's rights. You give us a limited license to reproduce them only on the products in your order.

Prices and quotes

Prices are all-in for the quantity you order: the product, one logo in one location, and setup. Prices can change until we accept your order. PDF quotes are valid for 30 days. Prices do not include sales tax. Shipping is shown at checkout. Ground shipping to one address is free on orders with a product subtotal of $1,000 or more. Shipping to many addresses is calculated per address and billed when the order ships.

Payment

Card, Apple Pay and Google Pay orders are charged when you place the order. Net 30 is available to approved business accounts, with invoices due 30 days after the invoice date. New Net 30 accounts need a credit review before production. Overdue amounts carry a service charge of 1.5% per month, or the highest rate the law allows if lower. All amounts are in U.S. dollars.

Delivery dates

Delivery dates on the store are estimates. Production starts after you approve your design, and orders placed by 2 pm ET on a business day count from that day. We are not liable for delays, and we may ship an order in more than one shipment. Title and risk of loss pass to you when we hand the order to the carrier.

Damaged, missing, misprinted or defective

Check your order when it arrives. Report damage, shortages, wrong items or misprints within 48 hours of delivery, or within 5 days for problems you can't see on inspection. Misprinted or defective? We reprint or replace it. For damage in transit, we help you file the claim with the carrier. Brand-name products also carry their manufacturer's warranty, and warranty claims go to the manufacturer.

Returns and cancellations

Every item is made with your logo, so all sales are final and there are no returns or refunds except as described above. Once we accept an order it can't be canceled or changed without our written OK, and changes may affect price and delivery date.

Brands and resale

Branded products are genuine and sourced through authorized brand channels. Brand names and logos belong to their owners, and MerchSetGo is not affiliated with or endorsed by them. Products are sold for your own use, including as gifts, and not for resale.

Events outside our control

We are not liable for delays or failures caused by events beyond our reasonable control, such as severe weather, carrier delays, supply shortages, labor disputes or government action.

Limits

Neither side is liable for indirect, incidental or consequential damages. Our liability for any order is limited to the price paid for the products involved.

Governing law

These terms are governed by the laws of the State of Illinois. Disputes go to the state courts in Cook County, Illinois, or the U.S. District Court for the Northern District of Illinois.
